- Places they may frequent such as a restaurant, coffee shop, fitness club…
BENEFITS FOR LANDLORD/TENANT CASES WITH PHOTO EVIDENCE
- Top 3 Rules for trials is … ‘Prepare, Prepare, Prepare’
- Photo evidence can help your case by proving or disproving unfounded ‘accusations’
- Lack of photos can allow the Judge/Adjudicator to hold over the hearing to a future date causing further delays, costs and loss of income.
- If damages are incurred any time after the date of the photos, the photos are now proof of any future claims and damages.
Frequently Asked Questions
Process Serving
Q: What is a Process Server?
A: A person who delivers legal documents such as summons, notices, small claims, family law, civil matters, collections, tribunals, court filings and other legal documents, who is not a party to a case. The documents are delivered to an individual or company to whom the legal documents are directed.
Q: What does a Process Server do?
A: A process server delivers and serves legal documents to a defendant or an individual involved in a civil court case. The process server must serve the documents in accordance with the legislation in the area of service. This may mean handing the documents to the defendant personally or sub-serving to someone in the same household or business.
Once the documents are delivered, the process serving agent must provide proof that the papers were served. This is done through a document called an Affidavit of Service, which must be commissioned.
Process Servers also file papers with the courts and can do document retrieval.
Q: Do I need a Process Server?
A: Hiring an experienced Process Server can be an important step in a court case or legal procedure.
1. A process server can save time, money, frustration and confrontations delivering time sensitive legal
documents correctly!
IE: Serving documents personally versus mailing, speeds up filing by 5 days for most matters. TIME = MONEY!
2. Process Servers can get important documents delivered while avoiding confrontations.
The party being served might be avoiding a recognized person.
3. There are certain requirements to serving depending on the area of law and the type of documents.
Any mistakes could cause unnecessary delays, extra costs and jeopordize your case.
