CRIMINAL DEFENCE

Canadian Criminal Law, governed by the Criminal Code, R.S.C. 1985, c. C-46, and is founded on the principles on the presumption of innocence and the right to a fair trial.

Principles and Legal Procedures

  • PRESUMPTION OF INNOCENCE  Individuals are considered innocent until proven guilty.
  • BURDEN OF PROOF The prosecution must prove the accused’s guilt, ‘beyond a reasonable doubt’
  • RIGHT TO FAIR TRIAL  Everyone is entitled to a fair trial, and the right to legal representation in
    a timely matter.
  • INDICTABLE vs. SUMMARY OFFENCES
Indictable offences are more severe while Summary Criminal Offences are less severe where the charges
if convicted, are zero days to less than 2 years jail, and have streamlined court processes.

    CONCLUSION
    1. Legal representation is crucial to protect your rights.
    2. Advocate a strong & successful defense on your behalf, and minimize or avoid a criminal record.
    3. We attend court on your behalf on certain appearances, where the accused does not need to be
    present.
    4. Legal representation can ease the stress of the legal system and the legal process.
